DRINK driver Kyle Mackay, Fraser Street, Golspie, has been banned from the road for a year and fined £900.

The 31-year-old was tested for excess alcohol in his system after crashing his car on the A9 at Dunrobin on 29th July last year.

A police officer driving on the same stretch of road came across Mackay’s vehicle at 8.45am, Tain Sheriff Court was told today.

Stewart MacIver, prosecuting, said: “The accused was at the scene and appeared to have injured himself. The officer contacted colleagues who attended and procedures followed.”

Tests showed Mackay to have 87 milligrammes of alcohol in 100 millilitres blood. The limit is 80 in 100.

Mackay, a leisure supervisor, had been at a social gathering the night before the accident.

Defence agent Rory Gowans said: “He had a quantity of alcohol and when he woke up, misjudged whether he was okay to drive.

“During the course of the journey he lost control of the vehicle. He says he would not have got into the car if he had known he was over the limit.”

Mr Gowans suggested that Mackay was a candidate for a drink-drive rehabilitation course given his “significant error of judgement”.

Sheriff Gordon Fleetwood said Mackay would receive a three month discount on his driving ban if he successfully completed the course.
